An advocate shall be entitled to act in any court proceeding on behalf of a party only after filing a Vakalath or Memo of Appearance in proper form as per Order III Rule 4 and 5 of the Code of Civil Procedure, 1908 (CPC).
However, an advocate already on record in any court proceeding appoints another advocate to appear for him at the hearing of a case, the latter need not file Vakalath, as per Order III Rule 5 of the CPC.
In another words, an advocate having no Vakalath for a party in a case can appear in the court proceedings as per the direction or instruction of the advocate who holds Vakalath for the party in the case.
