When a post is specifically intended for candidates possessing lower educational qualifications, allowing a person with higher qualifications to secure such employment would deprive a genuinely eligible and deserving candidate of the opportunity, the Supreme Court observed in General Manager (HR) & Anr v. K. Poovarasan [2026 INSC 581].
In this case, the Supreme Court set aside the order of the Madras High Court, which had reinstated a temporary bank attendant of Syndicate Bank. The attendant had obtained appointment to a post reserved exclusively for candidates with educational qualifications up to the 10th standard by concealing the fact that he was a graduate.
The Court relied on its judgment in Jomon K.K. v. Shajimon P. and Others [2025 INSC 425] and held that a candidate has no right to claim appointment merely because he or she possesses qualifications higher than those prescribed for the post.
