A Judgment Issued Based on AI Generated Fake Precedents Amounts to No Judgment

In Pooja Ramesh Singh v. Jammu and Kashmir Bank Ltd. and Anr. [2026 INSC 668], the Supreme Court of India held that any decision of a court or adjudicating authority based on fake, non-existent, or hallucinated material—including AI-generated precedents—amounts to no decision at all in the eyes of law.

The Court pointed out that such reliance subverts the rule of law and undermines the integrity of the judicial process, warranting immediate setting aside of such decisions.

It is professional misconduct for advocates to cite such judgments without verification and a serious lapse on the part of judges to rely on such non-existent precedents while deciding cases.
