Don’t Call District Judiciary as Subordinate Judiciary & Trial Court Records as Lower Court Records: SC

Use the term Trial Court Records

The Record of the Trial Court should not be referred to as Lower Court Record (LCR). Instead, it should be referred as the Trial Court Record (TCR), says the Supreme Court (SC) in Sakhawat & Another v State of Uttar Pradesh [2025 INSC 777].

The SC added that describing any Court as a “Lower Court” is against the ethos of our Constitution. The Registry has issued a Circular dated 28th February 2024 for giving effect to the order. The SC wants that the High Courts must take note of the above direction and act upon the same.

Call District Judiciary, but not Subordinate Judiciary

The SC, in an earlier judgement, said that the District Judiciary should not be termed as Subordinate Judiciary, says the SC in All India Judges Association v Union of India & Others.
