Past Service of Govt Employees in Corporations cannot be Counted for Pension

In a reference made as a result of conflicting opinions by two division benches, the full bench of the Kerala High Court, consisting three Judges, decided that the past service of government employees in statutory corporations, autonomous bodies and government companies cannot be treated as qualifying service for the purpose of Pension and Death cum Retirement Gratuity (DCRG), as per Kerala Service Rules.

This was decided by a three-judge bench of the Kerala High Court in Jayakumar S & Others v State of Kerala & Others [ 2021 (5) KHC 157 (FB)] by settling a set of cases filed by the parties challenging some orders of the Kerala administrative Tribunal.
