Evidence Cannot be Provided in Court Without Proper Pleadings

In the absence of pleadings submitted at the appropriate stage within the stipulated time, any amount of evidence submitted later, will not be taken into consideration by the court, says the Supreme Court (SC) in the case of Biraji @ Brijraji & Another. v. Surya Pratap & Others [AIR Online 2020 SC 806].

It is well settled that in absence of pleadings being submitted to the court, any amount of evidence will not help the party, says the paragraph 7 of the above judgement.

Pleadings and proof of such pleadings; by valid evidence led, is the crux and core of any adjudicatory process. Trite is the principle that there can be no proof offered without specific pleadings, says the SC in Manjudha & Others v United India Assurance Company Ltd. & Another [2025 INSC 896].
