Injunction can be granted against the owner
Injunction may be granted even against the true owner of the property, when the person seeking the relief is in lawful possession and enjoyment of the property and also legally entitled to be in possession. A true possessor can be evicted by the owner alone
A person in possession of land in the assumed character of owner and exercising peaceably the ordinary rights of ownership has a perfectly good title against all the world but the rightful owner, says the Supreme Court in TA. Subramanian v R. Pannerselvam, [(2021) 3 SCC 675].
